Case Summary

Colen Campbell developed mesothelioma after working as an insulator at Georgia Power’s Hatch nuclear plant and sued the company for asbestos-related premises liability and related damages. The trial court limited the claims to exposure during 1973 and 1974, admitted testimony from one causation expert, excluded another, and denied summary judgment in part. The Court of Appeals of Georgia affirmed the rulings admitting the first expert and allowing the duty claim to proceed. It vacated the rulings concerning the second expert and the statute-of-repose defense because the trial court had not properly resolved those issues, including whether Campbell’s claims were timely. The court remanded for further proceedings while declining to decide the unaddressed repose issue in the first instance.
