Case Summary

Girish Modi appealed an award of attorney fees and costs to the India-American Cultural Association after the trial court dismissed his complaint and granted judgment to the Association. Bankruptcy proceedings had previously required a stay and a remand concerning the fee award. The Court of Appeals of Georgia affirmed in part but vacated the portion of the award that rested on an incorrect legal analysis. It held that the trial court had to apply the proper statutory framework and determine whether the claimed fees and costs were sufficiently supported before entering a final award. The case was remanded for further findings and an order consistent with the opinion.
