Case Summary

Richard Glossip challenged his capital conviction after evidence showed that the prosecution failed to correct false testimony from its key witness. The Court held that it had jurisdiction and that the State violated its constitutional duty under Napue v. Illinois by allowing materially false testimony to stand uncorrected. The Court ordered a new proceeding rather than allowing the conviction to rest on the tainted record.
