Case Summary

Roshun Gray was convicted of malice murder and firearm offenses after Ferderian Bennett was shot and killed. He argued that he was legally incompetent to stand trial and that counsel was ineffective for failing to investigate his competency. The Georgia Supreme Court affirmed. The court held that the competency hearing evidence supported a rational finding that Gray understood the proceedings and could assist counsel. Gray also failed to show that further investigation would probably have produced a different competency determination. Because he could not establish deficient performance and prejudice, his ineffective-assistance claim failed. The court left the convictions and sentences intact. One justice did not participate.
