Case Summary

A public-housing tenant sued the Housing Authority of Augusta after unknown assailants tried to rob her on her porch and shot her in the leg. The Authority moved for summary judgment, arguing that it was protected by sovereign immunity. The Court of Appeals of Georgia agreed and affirmed. It held that in operating and managing low-income public housing, the Authority was acting as an instrumentality of the City of Augusta and performing an essential governmental function rather than a purely private one. Because no applicable waiver of sovereign immunity was shown, the premises-liability and negligent-security claims could not proceed.
