Case Summary

Hewitt required resentencing after an earlier firearm sentence had been vacated. The Court interpreted the First Step Act’s sentencing limitation and held that a sentence has been “imposed” only when it remains extant. A defendant whose prior section 924(c) sentence was vacated before resentencing may therefore receive the benefit of the Act’s more lenient penalty structure.
