Case Summary

Lamontez Hinton was convicted of malice murder and other offenses arising from the shooting death of one victim and the armed robbery of another. He argued that the evidence was insufficient and that the trial court should have granted a new trial under the thirteenth-juror standard. The Supreme Court of Georgia rejected those challenges and affirmed the convictions supported by the record. It nevertheless vacated Hinton’s aggravated-assault conviction involving the robbery victim because that offense merged into the armed-robbery conviction. The Court remanded for correction of the resulting sentence while leaving the remaining convictions undisturbed.
