Case Summary

Diara Hood was convicted of felony murder and related offenses arising from robberies that left one victim dead and another injured. She challenged the evidence and several sentencing and merger rulings. The Georgia Supreme Court affirmed in part and vacated in part. The court left the felony-murder and robbery convictions undisturbed but held that the aggravated assault of one victim arose from the same conduct as the armed robbery of that victim. That assault conviction therefore should have merged into the robbery conviction for sentencing. The court vacated the assault conviction and its twenty-year sentence while affirming the remaining judgment. The decision corrected the sentencing treatment without requiring a new trial on the underlying offenses.
