Case Summary

Ginger Cox challenged a probate-court ruling concerning Kitty H. Felker’s will and estate. She filed an appeal in superior court, which dismissed it for lack of jurisdiction and also questioned whether her claims presented a justiciable issue. The Court of Appeals of Georgia held that an appeal from the relevant Article 6 probate court belonged directly in the appellate court and that the superior court should transfer, rather than dismiss, a timely appeal filed there. The court vacated the dismissal and remanded with direction that the appeal and probate record be transferred to the Court of Appeals.
