In The Interest Of T.R. Et Al. Children (Mother)v.State Of Georgia
The mother of three children appealed an order terminating her parental rights. She challenged the findings that the causes of dependency would continue, that continued dependency would seriously harm two children, that termination served their best interests, and that the Department of Family and Children Services made reasonable reunification efforts. She also challenged the order’s nunc pro tunc date. The Court of Appeals held that the evidence was sufficient as to some statutory factors but that the juvenile court had failed to make required findings as to others. The appellate court also held that the mother had not preserved an argument that reunification services should have accommodated her disability by providing transportation. Because the findings were incomplete, the court vacated the termination judgment and remanded for additional proceedings. The challenge to the order’s date became moot after the judgment was vacated.
