In the Matter of Donald Francis Hawbaker
Deputies went to Donald Francis Hawbaker’s home to serve an arrest warrant for simple assault and disorderly conduct; he refused to leave and opened fire on them. Hawbaker pleaded guilty to five felony counts of aggravated assault on a peace officer and received concurrent 20-year sentences, with 10 years to serve. In the disciplinary proceeding, he petitioned to surrender his Georgia law license and admitted that the felony convictions violated Georgia Rule of Professional Conduct 8.4 (a) (2). The Supreme Court of Georgia accepted the surrender, concluding that the serious violent felonies and insufficient mitigation made continued practice damaging to public confidence; although Hawbaker cooperated and had no prior discipline, he did not acknowledge wrongdoing or express remorse. The Court treated the surrender as tantamount to disbarment, removed him from the roll of Georgia lawyers, and reminded him of his post-surrender duties; all Justices concurred.
