Case Summary

After a seven-day Judicial Qualifications Commission hearing, the panel found by clear and convincing evidence that Douglas County Probate Judge Christina Peterson committed 28 of 30 charged violations and recommended removal. The Supreme Court of Georgia upheld sanctionable misconduct on 12 counts across four matters: a criminal-contempt proceeding that denied a litigant due process; her treatment of county personnel, including requests for deputies after hours; communications with represented parties at an HOA meeting; and ex parte contacts in a year’s-support case. The Court found that Peterson’s conduct amounted to willful misconduct in office or conduct prejudicial to the administration of justice, and considered the pattern of violations and adverse credibility findings in choosing a sanction. It removed Peterson effective immediately and barred her from election or appointment to a Georgia judicial office for seven years. Justice Peterson concurred, arguing that the Georgia Constitution also permits suspension without pay as a disciplinary sanction after due process.
