Case Summary

Inyang Peter Oduok sued Grady Memorial Hospital and related defendants over injuries allegedly caused by medical treatment and the failure to provide appropriate care. The trial court dismissed different counts based on professional-negligence affidavit requirements, the sufficiency of the pleadings, and a later dismissal for want of prosecution. The Court of Appeals affirmed in part, vacated in part, and reversed in part. It held that some claims challenged professional judgment and required the statutory expert affidavit, while other claims alleged ordinary negligence and did not. The trial court also had to make factual findings before dismissing the action for lack of prosecution and had to consider whether Oduok received adequate notice and an opportunity to be heard. The appellate court left intact dismissals that were legally supported, reversed the dismissal of claims not subject to the affidavit requirement, and remanded with direction for further findings and proceedings. Two judges concurred.
