After a divorce fee dispute, J. Walker and Associates filed a $187,445 attorney lien against the former client’s home; the lien held up distribution of sale proceeds. Arbitration found no enforceable written fee agreement but awarded Walker $20,000. In the later litigation, the Court of Appeals reversed a $13,000 damages award because the amounts at issue had already been held not to be damages in the prior appeal. It affirmed attorney fees under Georgia’s litigation-expense statute: Walker’s challenge to the arbitration award was untimely, and refusing to remove or amend the lien unnecessarily expanded the case. The court also denied a request for frivolous-appeal penalties.
