Case Summary

Georgia gubernatorial candidate Richard Jackson challenged a state law permitting specified incumbent officials to operate leadership committees with fundraising and coordination advantages unavailable to competing candidates. The district court preliminarily enjoined Lieutenant Governor Burt Jones’s leadership committee from soliciting contributions or making expenditures for Jones’s campaign. The Eleventh Circuit affirmed. It held that Jackson had standing because the unequal fundraising regime placed him at a competitive disadvantage; that he was highly likely to establish a First Amendment violation; and that the committee likely acted under color of state law because Georgia created the special entity for select officeholders and intertwined it with the incumbent’s official position. The court also concluded that the constitutional injury was irreparable and that the balance of harms and public interest favored equal campaign-finance rules during the election.
