Jason Hambrick was convicted of rape, aggravated child molestation, incest, and cruelty to children. On appeal, he challenged discovery, ineffective assistance, expert and hearsay evidence, venue, merger, and the form of his sentence. The Georgia Court of Appeals rejected the challenges to the convictions and held that the evidence supported the verdicts. It nevertheless found that the written sentencing order stated a total of two hundred twenty years when the oral sentence and required split-sentence structure produced a total of two hundred nineteen years with life on probation. The court treated the discrepancy as a scrivener’s error and remanded for correction of the sentencing sheet. The convictions and the merits of the new-trial ruling otherwise remained intact.
