Case Summary

Jeff Bickerstaff pursued claims against SunTrust Bank in litigation that had already reached the Georgia Supreme Court, which reversed an earlier Court of Appeals decision and remanded for further proceedings. On remand, the Court of Appeals adopted the Supreme Court’s judgment and addressed the remaining issue concerning the effect of the remand on the pending claims. The court rejected the contention that the matter was moot and held that the trial court must determine the remaining issue, including whether the claims should proceed if a class were later certified. The panel reversed the trial court’s decision and remanded with direction. Two judges concurred.
