Case Summary

Jeff Giraldi was hospitalized after receiving a full-arm tattoo and later reported the matter to a county health department. The tattoo-studio owner sued him for defamation based on online comments and that report. Giraldi appealed the denial of his motion to strike under Georgia’s anti-SLAPP statute. The Court of Appeals of Georgia held that some of the challenged claims were subject to dismissal under the statute and that other portions of the trial court’s order required vacatur. The decision applied Georgia’s protections for petitioning and speech activity while examining the statutory procedure and the claims’ legal sufficiency. The judgment was reversed in part and vacated in part, and the court did not reach unnecessary remaining issues.
