Case Summary

Jeffrey Schaffer recorded an affidavit affecting title to property he had conveyed to Collinsville Meadow Townhomes. Collinsville sought an injunction requiring removal of the affidavit as a cloud on its title, and the trial court entered a permanent injunction after an emergency hearing. Schaffer appealed. The Court of Appeals of Georgia vacated the order and remanded because the trial court’s ruling and the record did not permit proper appellate review of the legal and factual basis for the injunction. The appellate court did not reach Schaffer’s remaining challenge after vacating the underlying order and directed the trial court to proceed under the correct framework.
