Case Summary

Raphael Johnson was convicted of malice murder, felony murder, aggravated battery, and other offenses arising from two shooting incidents. He challenged the sufficiency of the evidence, a jury instruction, and the admission of evidence from an earlier shooting as intrinsic evidence. The Supreme Court of Georgia rejected those challenges and affirmed the convictions supported by the evidence. It nevertheless vacated Johnson’s conviction and sentence for possession of a firearm during the commission of a felony because the conviction should have merged under Georgia sentencing law. The Court affirmed in part and vacated in part, leaving the remaining convictions undisturbed.
