Case Summary

Joseph Gene Walker was convicted of violating a sexual-offender restriction and of child molestation, loitering and prowling, public indecency, public drunkenness, and obstruction. He challenged the sufficiency of the evidence and several trial rulings, including the admission of victim-impact testimony during the guilt phase and the refusal to bifurcate the proceedings. The Court of Appeals of Georgia reversed the restriction conviction because the charged conduct did not establish the statutory violation, but affirmed the remaining convictions. The court held that the trial court’s errors concerning bifurcation and victim-impact evidence did not warrant a new trial given the strong evidence of guilt, and that their cumulative effect was not sufficiently prejudicial. The judgment was therefore affirmed in part and reversed in part.
