Case Summary

Josh Martin was convicted of aggravated assault involving family violence and false imprisonment. He challenged the sufficiency of the evidence, the admission of a prior aggravated-assault conviction to show intent, and a $5,000 probation condition requiring reimbursement of attorney fees. The Court of Appeals of Georgia affirmed the conviction and the evidentiary ruling. It held that the evidence supported the aggravated-assault conviction and that the prior conviction was admissible for the purpose presented. The court nevertheless vacated the attorney-fee condition because the trial court had not adequately considered Martin’s ability to pay, and remanded for further proceedings on that issue.
