Keith Mitchell was convicted of multiple offenses arising from a violent confrontation with a former romantic partner and her child, including false imprisonment and sexual offenses. He challenged the sufficiency of the evidence, the jury instruction on venue, testimony concerning his pretrial detention, and the legality of his sentence. The Court of Appeals affirmed the convictions but vacated the sentence and remanded for resentencing. The court held that the evidence supported the false-imprisonment convictions and that the challenged trial rulings did not require reversal of the guilty verdicts. It nevertheless concluded that two pairs of aggravated-sodomy and rape counts were indistinguishable as charged. Although the evidence showed separate criminal acts, the indictments did not make the dates or occurrences material in a way that authorized separate sentences on those identical counts. The trial court therefore had to merge the duplicate counts for sentencing. The court left a separate aggravated-sodomy conviction intact because it alleged different conduct. The judgment of conviction was affirmed; the sentence was vacated and remanded. Two judges concurred.
