Lakyia Sexton-Johnson was convicted of felony obstruction after punching and kicking an officer who was trying to remove an intoxicated passenger from her vehicle. She was also convicted of possessing open alcohol containers while operating a vehicle. The Georgia Court of Appeals held that the officer was lawfully performing his duties during the escalating encounter and that the evidence supported the obstruction conviction. It also held that Georgia’s open-container traffic offense is a strict-liability offense, so the State did not need to prove that Sexton-Johnson knew the bottles were in the passenger area. The evidence nevertheless authorized that conviction as well. The court affirmed in part and reversed in part on a separate legal issue concerning the judgment, and it explained that any retrial of the reversed count would not violate double jeopardy.
