Case Summary

Larry and Lynn Oldham appealed orders dismissing their abusive-litigation complaint and declaring moot their motion to add a party. The case arose from a dispute over duplicate conveyances of real property and attorney-fee claims. The Court of Appeals of Georgia vacated both orders and remanded for further proceedings. The majority held that the trial court had not applied the correct framework to the abusive-litigation claim and related party-substitution issues. A dissent would have affirmed, concluding that the defendants had a complete good-faith defense.
