Case Summary

Kevin James Lee was convicted of murdering his wife, Ann Berry, after she disappeared in 1991 while trying to leave their abusive relationship; her remains were found near their home in 2011. The Supreme Court of Georgia affirmed, holding that the circumstantial evidence, including Lee’s changing accounts and history of abuse, supported the verdict, and rejecting his challenges to hearsay evidence and a juror’s excusal. It also held that counsel was not ineffective for failing to pursue a speedy-trial plea in bar because the record did not support a meritorious constitutional claim, or for mishandling a plea offer because Lee understood its terms and chose trial. The convictions and sentences were affirmed.
