Loftonv.The State
Reginald Lofton was convicted as a party to felony murder arising from the armed robbery and shooting death of a pizza-delivery driver. He challenged several evidentiary rulings and alleged that trial counsel was ineffective. The Georgia Supreme Court affirmed. The court held that the challenged evidence was properly admitted or that any error was harmless in light of the substantial evidence showing Lofton’s participation. It also rejected the ineffective-assistance claims, including the allegation that counsel failed to object to improper closing argument. The court considered the combined effect of the assumed evidentiary errors and counsel’s deficiencies, but held that the cumulative prejudice did not deprive Lofton of a fundamentally fair trial. The conviction and sentence therefore remained in place.
