Case Summary

Antavian Love was convicted of malice murder and related offenses committed when he was 16. He challenged the admission of statements to law enforcement and his sentence of life without parole as a juvenile. The Georgia Supreme Court affirmed. The court held that the statements were admissible under the circumstances of the interrogation and that the trial court properly evaluated voluntariness. It also rejected Love’s Eighth Amendment challenge to juvenile life without parole under the governing Georgia and federal precedents. The court explained that broader policy arguments against such sentences were matters for the General Assembly rather than a basis for reversal under the law applicable to the case. The convictions and sentence remained in place. One justice did not participate.
