Case Summary

LuAngela Carla Gibson-Wright, an Alapaha city council member, appealed a protective order entered for Rudolph Smith after the trial court found that she had committed stalking. She argued that the evidence was insufficient and that the court improperly denied her request for attorney fees. The Court of Appeals of Georgia reversed the protective order. It held that the record did not establish the statutory elements required for stalking and that the trial court’s ruling could not stand on the evidence presented. The appellate court also vacated the denial of Gibson-Wright’s attorney-fee claim and remanded for reconsideration under the applicable fee statutes. The final disposition was reversed in part, vacated in part, and remanded with direction.
