Case Summary

Anthony Lumpkin and Eddie Green were convicted of murder and related offenses in the shooting death of Nicholas Jackson. They challenged evidence seized during a traffic stop, while Lumpkin also challenged the sufficiency of the evidence and Green challenged the exclusion of evidence. The Georgia Supreme Court affirmed Green’s judgment and affirmed Lumpkin’s judgment except for a sentencing merger error. The court held that the traffic-stop evidence was admissible, Lumpkin’s evidence supported the armed-robbery and felony-murder convictions, and Green was not entitled to the evidentiary ruling he sought. The court vacated Lumpkin’s aggravated-assault conviction and sentence because that offense merged with the felony-murder conviction based on the same shooting. The remaining judgments were left intact.
