Case Summary

Matthew Charles Cardinale pursued multiple public-records requests from Atlanta officials and private parties. In two related appeals, he challenged the denial of a motion for default judgment and the dismissal of an Open Records Act complaint. The Court of Appeals of Georgia affirmed the denial of default judgment, but reversed in part, vacated in part, and remanded the dismissal of the complaint against a private attorney and a councilman. The trial court had not addressed an alternative argument that the response to Cardinale’s request satisfied the Open Records Act, so the appellate court left that issue for the trial court to decide first.
