Mendezv.Moats Et Al.
The Georgia Supreme Court vacated its writ of certiorari in a dispute involving the statutory deadline for claims against counties. The Court had granted review to address whether the ante litem statute applied to the claims and how its limitation period should be interpreted. After reviewing the record and briefs, the Court determined that the writ had been improvidently granted and denied the petition. The Court did not decide the underlying statutory questions. The Presiding Justice explained that the issues remained important and might be better addressed in a future case, while a separate dissent would have reached the merits. The order therefore resolved this case procedurally without establishing a substantive interpretation of the statute.
