John Mitchell Reid challenged an order granting his mother, Vickie Lindsey, visitation with his twelve-year-old son. Lindsey had cared for the child for much of his life while the child’s twin brother underwent serious medical treatment, and the trial court found that cutting off the relationship would harm the child. The Court of Appeals affirmed the visitation award but reversed an order requiring Reid to pay half of the guardian ad litem’s fees. The evidence supported the trial court’s finding that Lindsey had provided substantial and stable care and that continued contact served the child’s best interests. The court also held that Georgia law places the expense of a guardian ad litem in this type of grandparent-visitation case on the petitioning grandparent. A consent order cannot impose a payment obligation that the statute prohibits. The visitation provisions therefore remained in force, while the fee allocation was reversed.
