Case Summary

Roy Moore sued over tweets, a post-election press release, and a campaign advertisement that referenced allegations that he had pursued teenage girls. The Eleventh Circuit held that the Alabama defendants’ Twitter contacts did not establish personal jurisdiction for the tweet-based claims, and that the press release and advertisement did not plausibly allege the falsity and actual malice required for defamation. It affirmed dismissal under Rules 12(b)(2) and 12(b)(6).
