Case Summary

The United States contended that the Emergency Medical Treatment and Labor Act requires stabilizing abortion care in some medical emergencies notwithstanding Idaho’s abortion prohibition. After expedited proceedings and a stay affecting the district court’s injunction, the Supreme Court dismissed the writs of certiorari before judgment as improvidently granted. It did not decide the merits of the claimed conflict between EMTALA and Idaho law. The Court vacated its stays, allowing the district court’s preliminary injunction protecting federally required emergency care to take effect while litigation continued in the lower courts.
