Case Summary

A police sergeant alleged that the city transferred her to a less desirable position because she was a woman. The Eighth Circuit required proof that the transfer caused a significant employment disadvantage. The Supreme Court rejected that heightened standard. A Title VII plaintiff challenging a discriminatory transfer must show some harm with respect to the terms or conditions of employment, but the statute does not require the harm to be significant, substantial, or economically measurable. Because the lower court applied too demanding a test, the judgment was vacated and the case remanded.
