Case Summary

Andrew Murray was convicted of malice murder and related crimes. During post-trial proceedings, he rejected several appointed attorneys and appeared at the final motion-for-new-trial hearing while claiming to be represented by a different person. The trial court dismissed or denied the amended motion because that purported representative had not supported it and Murray did not properly appear. The Supreme Court of Georgia vacated the order and remanded. It held that the stated reasons were not lawful grounds for disposing of the amended motion and that the trial court had to consider its merits. The Court acknowledged Murray’s disruptive conduct but held that it did not authorize bypassing the required post-trial process.
