Case Summary

After Wayne Johnston reported fatigue and shortness of breath, Dr. Ravin Talati ordered blood tests that showed severe anemia, but the results were not reviewed before Johnston died ahead of his scheduled follow-up. Johnston’s estate sued Talati, nurse practitioner Mary Chastain, and MyFamilyDoc, alleging that the delay in reviewing the emergency results caused his death. The Court of Appeals reversed the denial of summary judgment to Chastain: she had separate patients, had never treated Johnston, and the estate identified no evidence that Talati asked her to review his results or that she was first available when the lab called with critical findings. The court affirmed admission of the estate’s causation expert, who considered Johnston’s cardiovascular disease and other comorbidities and explained how the newly severe anemia worsened those otherwise stable conditions; the opinion rested on more than timing alone. The trial court did not abuse its discretion in finding the expert methodology reliable, so the court left the remaining rulings undisturbed.
