Case Summary

Irene Neely appealed after a trial-court order resolved title to a boundary strip but left her neighbors’ counterclaims pending. The neighbors later dismissed those claims shortly before trial; the Court of Appeals treated Neely’s appeal as late because it measured the deadline from the earlier order. The Supreme Court of Georgia held that the later dismissal could make the earlier order final and start the appeal period then. It vacated the dismissal of Neely’s appeal and remanded for the Court of Appeals to consider it, overruling prior decisions that made the original order date the only possible measure of finality.
