Case Summary

North Walhalla Properties, a condominium owner, sued its association and a manager over property-related claims and challenged the association’s counterclaim for unpaid assessments, interest, fees, and attorney fees. The trial court granted summary judgment to the defendants, concluding that Walhalla lacked standing to bring claims that belonged in a derivative action. The Court of Appeals affirmed the judgment on the association’s counterclaim. It held that Walhalla remained liable for the assessments and related amounts and was not entitled to an offset or attorney fees because it had not obtained relief on its own claims. The appellate court nevertheless vacated the judgment for the association and its manager on Walhalla’s complaint because the proper consequence of the standing ruling was dismissal, not summary judgment on the merits. It remanded with direction that the complaint be dismissed.
