Case Summary
Texas and private parties sought review of a Nuclear Regulatory Commission licensing decision even though they had not participated in the underlying agency proceeding. The Court held that the Hobbs Act’s judicial-review pathway requires the challenger to have been a party to the agency proceeding. The Court therefore rejected the asserted route to review without reaching the broader merits challenge.
