Case Summary

Wanda Nuckles was charged with depriving an elder person of essential services and concealing his death. She moved to suppress a video recorded by a concealed camera in the room where she worked at a rehabilitation facility, arguing that the recording violated Georgia’s privacy statute. The Georgia Supreme Court affirmed. The court held that Nuckles had no reasonable expectation of privacy in the portion of the room captured by the camera while she was performing work duties. The State therefore met its burden to show that the recording was admissible, and the trial court properly denied suppression. The court left the evidentiary ruling in place.
