Case Summary

Oklahoma and Utah challenged EPA disapprovals of state implementation plans under the Clean Air Act. The Court held that the disapprovals are locally or regionally applicable actions and therefore are reviewable in the appropriate regional court of appeals. The decision rejected treating every action with nationwide consequences as subject to exclusive D.C. Circuit review.
