Case Summary

Glynn County sought payment under public-official bonds after discovering that a superior-court employee had embezzled county funds. Old Republic Surety argued that the County’s demand and lawsuit were untimely and that other bond conditions had not been met. After cross-motions for summary judgment, the trial court awarded the County more than $339,000 plus interest. The Court of Appeals of Georgia held that the applicable statute of limitation barred the action. The County had enough information about the loss before it notified Old Republic, and it filed suit more than three years later. The court reversed the summary judgment and interest award for the County and did not reach the remaining arguments.
