Case Summary

Peyman Pakdel and his wife partially owned a San Francisco residential building and sought an exemption from a local law requiring them to give their tenants lifetime leases. After the city rejected the exemption, they filed a regulatory-takings claim under the Fifth Amendment. The Ninth Circuit required them to complete additional administrative procedures before the claim was ripe. The Supreme Court held that a takings claim is ready for review once the government has reached a final decision about the property at issue. The Constitution and Section 1983 did not require the owners to exhaust state administrative remedies, and the city had firmly rejected their request. The Court vacated the Ninth Circuit’s judgment and remanded for proceedings consistent with that rule.
