Case Summary

Jesus Perez was convicted of malice murder, armed robbery, and concealing a death after Boydrick Powell was killed. He challenged the evidence and the trial court’s instructions and treatment of the prosecution’s conspiracy argument. The Georgia Supreme Court affirmed. The court held that the evidence was sufficient and that any possible instructional or argument error was harmless in light of the record and the strength of the State’s case. The court found no reversible error in the parties-to-a-crime instruction or in the prosecutor’s use of the word conspiracy. Perez failed to show that the jury was misled or that the alleged error affected the verdict. The convictions and sentences therefore remained in place.
