Case Summary

The Rabun County Board of Education appealed a superior-court order reversing the State Board of Education’s decision upholding the nonrenewal of teacher Bronwyn Randel’s contract. The Court of Appeals of Georgia held that the superior court used the wrong legal theory when it concluded that Randel was entitled to a substitute tribunal in place of the local board. It reversed and remanded for the superior court to address Randel’s preserved alternative arguments under the Georgia Fair Dismissal Act and the applicable appellate-review framework. The appellate court declined to decide those issues in the first instance because the superior court had not ruled on them.
