Case Summary

After former state senator Colton Moore tried to enter the Georgia House chamber despite a ban, he sought an arrest warrant against House employee Randall Williams, who had stopped him. A magistrate denied the application. On Moore’s petition for review, the superior court ordered an entirely new magistrate hearing instead of reviewing the existing decision. The Court of Appeals reversed: Georgia’s review statute required the superior court to use the lower court’s record, defer to supported factual findings, and review a discretionary warrant decision for abuse of discretion. Missing video exhibits did not authorize it to substitute a fresh hearing without following the statute’s record procedures. The case returns to superior court for proper review. The appellate court expressed no view on whether a warrant should issue.
