Case Summary

Holocaust survivors and their heirs sued Hungary over property allegedly seized during the Second World War. The Supreme Court granted review in a companion case involving the Foreign Sovereign Immunities Act’s expropriation exception. After deciding Federal Republic of Germany v. Philipp, the Court issued this one-page per curiam disposition. It vacated the judgment of the Court of Appeals for the District of Columbia Circuit and remanded for further proceedings consistent with Philipp. The Court did not separately resolve the merits of the survivors’ claims in this order. The disposition required the lower court to reconsider the case under the Supreme Court’s interpretation of the statutory exception and the domestic-takings rule.
