Case Summary

Rodney Clinton entered an Alford plea to incest and child-molestation charges and received a forty-year sentence, with fifteen years to serve. After obtaining an out-of-time appeal, he argued that his convictions were invalid because the trial court accepted his plea without a factual basis for one incest count. The Court of Appeals of Georgia agreed in part. It reversed the conviction on that count because the record did not establish a factual basis for the plea, but it upheld the remaining incest and child-molestation convictions because the record supported those pleas. The case was remanded for resentencing.
